Moody Slogan Competition - Terms and Conditions

1. Information on how to enter this competition and prize details form part of these terms and conditions of entry (Terms).

2. The promoter is the B.I. Moody III College of Business Administration (Moody College) at the University of Louisiana Lafayette (UL Lafayette).

3. Entry is open to all current UL Lafayette students, faculty and staff as of September 29th, 2014.  Entrants must be 18 years of age or over. A current Common Logon IDentification (CLID) and @louisiana.edu e-mail address will be required to submit an entry.

4. Each entrant may submit a maximum of one entry to the competition.

5. By participating in this competition, entrants acknowledge that they have read and understood these Terms and Conditions and agree to be bound by them.  Entries must comply with these Terms and Conditions to be valid.

6. This is a ‘game of skill’ and chance plays no part in determining the winners.  No entry fee is required to enter this competition.

7. The competition commences on Monday, September 8, 2014 at 9:00am CST and will conclude on Wednesday, September 17, 2014 at 6:00pm CST (Competition Period).

8. To enter, entrants must, before the close of the Competition Period, submit their entry on the site business.louisiana.edu/slogancompetition that meets the entry criteria detailed in clause 21 below. 

9. All entries become the property of UL Lafayette.  All complying entries may be made public and UL Lafayette reserves the right to use all or part of the tagline entered by an entrant in promotional materials without further permission from the entrant or payment of compensation.

10. If an entrant’s contact details change during the Competition Period, it is the entrant’s responsibility to notify Moody College in writing to bestinbusiness@louisiana.edu.

11. There will be one winner determined by the selection committee.  The decision of the committee is final and no correspondence will be entered into regarding the decision. In the case of a tie, the dean of Moody College will select the winner.

12. If there are multiple entries of the same slogan, the individual who submitted first via the webform on business.louisiana.edu/slogancompetition will receive the prize if that slogan is selected as one of the top entries.

13. If no entry is deemed to be of sufficient quality, no winner will be selected and all prizes will be forfeited.

14. The winner will be notified on Monday, September 29, 2014 via their return e-mail address and their name will be published on Moody College website.  The College will use all reasonable efforts to contact an entrant selected as the winner by e-mail, but accepts no responsibility if an entrant cannot be contacted.  An entrant who cannot be contacted by e-mail will forfeit the prize in its entirety.

15. By entering, entrants:
       a. confirm that the content of their entry is original, their own and does not infringe the intellectual property rights or any other rights of third parties;
       b. grant UL Lafayette and Moody College a perpetual, royalty-free, irrevocable, worldwide, non-exclusive license (with the right to sub-license) to use, reproduce, modify, adapt, screen in public, communicate to the public, and otherwise exploit the tagline entered by the entrant  in any media (whether known now or developed in the future), for any purpose (including to advertise or promote any of the competition, the College and University products and services);
       c. consent to any act or omission by UL Lafayette that would otherwise infringe any moral rights that may subsist in their entry;
       d. agree to the use of their entry (in whole, edited, modified or altered form) and the entrant’s name for the purpose of promoting any of this competition, Moody College, and any of Moody College or UL Lafayette products services in any media worldwide; and
      e. agree to sign any further documentation required by UL Lafayette and Moody College to give effect to this clause.     

16. The prizes for top entries are as follows:
       a. One (1) First prize - $500 gift card to Best Buy
       b. Two (2) Second prizes - each $250 gift card to Best Buy
       c. Three (3) Third prizes - each $100 gift card to Best Buy

17. Before the prize is awarded, the winner will be required to sign an Intellectual Property Assignment and Release and Indemnity Agreement, the terms of which will be determined by UL Lafayette in its absolute discretion. Failure to sign the Intellectual Property Assignment and Release and Indemnity Agreement when required will result in forfeiture of the prize.

18. An entry selected as a winner will be deemed invalid unless, within seven (7) days of being notified that their entry has been selected as a winning entry, the winner:
       a. provides any information required by Moody College and UL Lafayette to verify the validity of their entry and their identity; and
       b. signs the Intellectual Property Assignment and Release and Indemnity Agreement referred to above if requested by UL Lafayette.

19. The prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize, or any element of it, as stated.  Moody College reserves the right to substitute the prize in whole or in part for something of equal or greater value if any component of the prize is unavailable (subject to any applicable legislation).  Prizes are not transferable, deferrable, exchangeable or redeemable for cash. Unused portions of the prize will be forfeited and no compensation will be payable in lieu of that element of the prize.

20. The winner accepts the prize at their own risk.  None of Moody College or The University of Louisiana at Lafayette, its related entities or any of their employees, contractors and agents (or employees of their contractors and agents) will be liable for any liability, loss, damage or expense (including but not limited to direct, indirect or consequential loss or loss of profits), or death or personal injury, suffered or incurred (whether or not arising from any person's negligence) arising out of, or in connection with, this promotion, the provision of the prize, use or participation in the prize or marketing of this promotion, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

21. Entry Criteria.  To be eligible for entry, entries must:
       a. describe in English what Moody College means to you and what would encourage students to be a part of the College (slogans are usually three to seven words in length)
       b. be your own original work;
       c. not contain any material which might infringe the intellectual property rights or any other rights of third parties;
       d. not include explicit or offensive material such as harsh/coarse/racist/abusive language;
       e. once a slogan has been submitted, it is final and may not be replaced by another slogan.

22. Incomplete, illegible, indecipherable and late applications are invalid.  Moody College accepts no responsibility for late entries or entries not received for any reason. 

23. Moody College reserves the right to disqualify any entries in its absolute discretion.  For example, Moody College may disqualify: (a) any entrants or entries that tamper with, or attempt to tamper with the entry process; (b) incomplete, indecipherable or illegible entries or entries containing false information or incorrect contact details; (c) any entries that contain material that is obscene, indecent, objectionable, defamatory, libelous or otherwise contravenes an applicable law or infringes any third party's rights; and (d) any entries that Moody College considers inappropriate for any reason.

24. Moody College reserves the right, at any time, to verify the validity of entries and the details provided by entrants (including without limitation an entrant’s identity, age, authorship of the entry) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions.  The information necessary for verification is at the sole discretion of UL Lafayette and Moody College.  Failure by UL Lafayette to enforce any of its rights at any stage does not constitute a waiver of those rights.

25. Each entrant must comply with these Terms and Conditions.  Each entrant indemnifies and will keep indemnified UL Lafayette and Moody College in relation to all loss and damage whatsoever which is suffered (including but not limited to indirect or consequential loss) by UL Lafayette or Moody College as a direct or indirect result of the entrant acting inconsistently with or breaching any part of these Terms and Conditions.

26. If for any reason this competition is not capable of running as planned, including as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Moody College which corrupt or affect the administration, security, fairness, integrity, safety or proper conduct of this competition, Moody College reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, subject to any applicable legislation.

27. Moody College may, in its sole discretion, invite the winner to act as an Ambassador for Moody College. 

28. Each entrant acknowledges that Moody College makes no promise that the winning entry will be used by Moody College and the final decision as to whether or not to use the winning entry rests solely with Moody College.

29. Privacy Statement. Entrants' personal information is collected by UL Lafayette, and may be disclosed to UL Lafayette contractors and agents (including without limitation marketing and promotional agencies, information technology providers and database service providers) to conduct, administer and publicize this competition. If the entrant’s entry contains personal information about the entrant, the entrant agrees to the use and disclosure of that personal information as set out in these Terms and Conditions. If an entrant does not provide the personal information requested in any entry form, they will not be able to enter the competition. If inaccurate or incomplete personal information is provided, UL Lafayette and Moody College may determine that the entrant is ineligible to win a prize. Entrants can request access to their personal information by contacting Moody College at bestinbusiness@louisiana.edu.

30. UL Lafayette’s decision on all aspects relating to this competition is final and no correspondence will be entered into.
